ICC: Lubanga: OTP Ordered Disclosure

2010-03-15, The Hague, The Netherlands. The OTP was ordered to reveal the identity of the intermediary accused of coaching witnesses. The OTP and the Victims and Witnesses Unit will introduce protection measures once the identity of the witness is disclosed.

ICC: OTP Staff Defends Intermediaries and Praises Ocampo

2010-03-16, The Hague, The Netherlands. Béatrice Le Fraper du Hellen in her interview to the Lubanga Trial Website explained that intermediaries do not conduct investigations on behalf of the OTP but only solicit witnesses and they are reimbursed for their expenses but nothing else. She completely rejected the defense’s claims that the OTP violates its disclosure obligations, saying that disclosure of “exonerating evidence” to the defence is an absolutely new concept in international justice and that “Ocampo an experienced … a very accurate and fair prosecutor. Ms. Hellen also stated that both intermediaries’ misconduct allegations and those related to late, incomplete disclosure and the abuse of process constitute the defence’s last chance because they don’t have any other arguments.
